WHEREAS, the Board of Governors (the “Board”) of the Philadelphia Bar Association (the “Association”) previously adopted a Resolution Opposing the Federal SAVE Act and Supporting Voting Rights for Eligible Pennsylvania Citizens on October 23, 2025 (the “Prior Resolution”); and,

WHEREAS, the Prior Resolution made clear the position of the Association on the federally-proposed “SAVE Act”, H.R. 22, building on decades of policy positions opposing legislation that would disenfranchise eligible voters, purge voter rolls, reduce access to the ballot box to eligible Americans and raise unnecessary and costly barriers to participate in the democratic process; and,

WHEREAS, further legislation has been proposed in the United States Congress now known as the “SAVE America Act”, H.R. 7296 and S. 3752, has been proposed which, among other things, would expand on the previously-proposed SAVE Act and limit access to participate in American elections to eligible voters; and,

WHEREAS, state legislators in the Commonwealth of Pennsylvania have proposed parallel state legislation, the Secure and Fair Elections Act, HB 284, that would seek to accomplish many of the same onerous voting and registration requirements of the SAVE Act and the SAVE America Act and impose same at the state level.

NOW THEREFORE, BE IT RESOLVED, that the Philadelphia Bar Association hereby expands the Prior Resolution and opposes the federal proposed SAVE America Act, H.R. 7296/S. 3752, the Secure and Fair Elections Act, HB 284 in the Commonwealth of Pennsylvania General Assembly, and such other similar legislation not in alignment with this Resolution and the Prior Resolution, insofar as the proposed legislation are not necessary to protect the security of elections or prevent voter fraud by noncitizens, would be a costly and time-consuming burden on state and local election officials, and would impose discriminatory barriers to citizens’ fundamental rights to vote and participate in our democracy; and

BE IT FURTHER RESOLVED, that the Philadelphia Bar Association authorizes the Chancellor and/or the Chancellor’s designee(s) to communicate the contents of this resolution to the Senators and Representatives elected to represent Pennsylvania in the United States Congress, and other government officials, bar associations, the legal profession, the media, and the public and take any and all additional action that is necessary to effectuate this resolution.
