Fighting Over Fido: The Latest Case Law and Statutory Developments Involving Companion Pets in Divorce

Because pets are often loved and treated as family members, custody of the family pet/companion animal can lead to some heated disagreements in the course of a divorce.

In the latest session before the Pennsylvania General Assembly, H.B. 97 would establish amendments to the Divorce Code to allow for the “special consideration” of companion animals when the division of assets is determined. Which party meets the daily needs of the companion animal? Which party provides the companion animal with social interaction? Which party is generally responsible for veterinary care? If passed by the Pennsylvania legislature and signed into law, our Commonwealth will join the growing number of states (CA, NY, IL, etc.) to deal with this challenging issue.

As Animal Law is now taught at most law schools in the United States, this CLE will cover recent case law developments in Pennsylvania, including a 2024 precedential decision by the Pennsylvania Superior Court in Clever v. Clever, involving a request to partition two corgis.
