Navigating Attorney Fee Disputes and Section 440/Lorino Attorney Fee Requests

Attorney fees in workers’ compensation matters have been radically reshaped in appellate court decisions in the last ten years. Claimant and defense attorneys should understand where the law currently stands in order to keep the system fair and litigation smooth.

This CLE program examines the tricky problems that may arise when a client discharges an attorney including issues regarding potential settlement offers being made and new counsel entering an appearance.  The speakers will address the balance of claimants’ fundamental right to select new counsel with attorneys' expectations of receiving reasonable legal fees. In addition, the program will explore the evidence that needs to be submitted to support claims of a discharged attorney to be compensated for their time and costs spent while litigating the case.

Finally, the speakers will review the current status and any new case law developments regarding Section 440 fee requests under Lorino v. WCAB. What are the best practices to request a Lorino fee for Claimant’s counsel and how should Defense counsel respond to these requests?
