How to Avoid the Dismissal of a Complaint for Lack of Timely and Diligent Service After the Applicable Statute of Limitations Has Expired

This CLE will examine a series of Pennsylvania Supreme Court decisions, beginning with the 1976 landmark case of Lamp v. Heyman, and continuing through to the most recent 2024 pronouncement in Ferraro v. Patterson-Erie Corp. d/b/a Burger King, which have attempted to clarify and refine the “good faith” standard imposed on Plaintiff’s counsel to establish diligent, timely and proper service of original process. Panelists will also address the “John Doe” pleading practice and the duty of Plaintiff’s counsel to exercise due diligence in identifying unknown defendants.
