Unlike most patent systems around the world, in the United States parties have the opportunity to use numerous specialty proceedings at the United States Patent & Trademark Office (USPTO) to strengthen their own issued patents, to challenge the validity of third-party patents, and to determine ownership of inventions. This CLE program will detail these specialty proceedings, discuss their pros and cons, and outline best strategies to use them to maximize client goals.
