ERISA at 50: A Golden Anniversary Update and Prudent Investment Practice Tips for Litigators

This insightful CLE begins with an introduction of what all litigators should know about ERISA in its 50th anniversary. Panelists address the basics of ERISA, fiduciary issues and applicable case law, the impact of the recent SCOTUS decision on the Chevron Doctrine, ERISA's nuanced landscape of litigation issues relating to excessive fees claims, use of account forfeitures, auditing, and more. Panelists will add a spotlight on Lewandowski v. Johnson & Johnson, an employee benefits class action lawsuit with significant implications for employers, among other recent noteworthy cases. In addition, hear procedural prudence requirements for plan fiduciaries in administering employee benefit plans subject to ERISA, as well as non-ERISA church and governmental plans.

Finally, learn potential areas of litigation related to plan sponsors and their responsibilities relative to selecting and monitoring investments.  Receive guidance on the following:

  • Function of a Retirement Plan Committee
  • Investment Policy Statement
  • Investment Due Diligence criteria, including ESG challenges
