Navigating Venue: Strategies and Considerations in Light of Pennsylvania’s Revised Venue Rule in Medical Malpractice Cases

Since the passage of the Medical Care Availability and Reduction of Error Act more than 20 years ago, venue in medical professional liability actions has been restricted to the county where the cause of action arose. However, the Supreme Court of Pennsylvania eliminated this venue carve-out rule, effective January 1, 2023, thereby granting plaintiffs greater flexibility in selecting the venue in which to file a medical professional liability action.

This practical 2-hour CLE program will provide attendees with a comprehensive understanding of the new venue rule, essential litigation strategies for adapting to this paradigm shift, and a detailed examination of its impact on medical malpractice filings in Philadelphia County.
