In this CLE presentation, panelists with extensive backgrounds in both Criminal and Workers’ Compensation Law will address day to day concerns when there is overlap between the criminal and workers’ compensation systems. Practical issues will be examined including, how to best communicate with your client who is incarcerated, obtaining treatment records from a prison infirmary, and how workers’ compensation subpoenas are addressed by the criminal justice system incorporating the Criminal History Record Information Act (CHRIA) and Pennsylvania’s Right to Know Act. Evidentiary issues will also be explored including, the comprehensive law and effect of Crimen Falsi convictions, lesser included offenses of misdemeanors, and felony offenses which impact potential Violation of Law affirmative defense and admission of prior Crimen Falsi convictions.
