Demonstrative evidence is a powerful civil litigation tool. Demonstrative evidence can be used to bring cases to life before jurors’ eyes. By incorporating pictures, videos, and animations into presentations and testimonies, attorneys can tell the story in a manner that is both impactful and compelling. 

Increasingly, computer-generated animations and simulations, illustrations and demonstratives are being used in courtrooms across the country. Although these tools can assist jurors in understanding complex issues, they can also distract from and distort the facts of a case. In recognition of the power these evidentiary tools can hold over jurors, courts across the country have erected barriers to admission and often rigorous foundational requirements.

This presentation will address, from both the plaintiff and defense perspectives, the legal and practical aspects of demonstrative evidence. The featured speaker will provide guidance on standards for admissibility, foundational requirements for use, challenges to this evidence, how to, when to and the effectiveness when using these evidentiary tools, as well as strategies for creating and using demonstrative evidence.
