This 2-hour trial skills CLE program offers guidance on best practices to start and close your case successfully. You will learn ways to develop and improve trial preparation, as well as techniques to ethically close your case… and the file confidently.

Preparing for trial can be nerve-wracking! There’s much to organize – witnesses, exhibits, the opening and closing statements… that’s why preparation is key. Our featured speaker begins this CLE with Preparing for Trial: Your Message, Elements of Proof, and Organizing your Presentation. The first hour of the program addresses:

  • Understanding the business/ethics side of litigation, and ethics of fee-setting
  • Understanding WHY you’re going to court
  • Developing a trial Theme
  • Defining elements of case or defense, and evidence required for each
  • Preparing witnesses ahead of time
  • Simple yet effective presentation techniques; order of presentation
  • Understanding standard objections
  • Ethical rules about evidence, offers of testimony and the duty to correct false testimony
  • Drafting your judgment early, and other necessities
  • Courtroom Choreography – where you’ll sit or set up, and the room
  • Keeping track of exhibits and rulings during trial
  • Handling your Client throughout the process - reasonable expectations

The second hour of this program, Closing the Case,… and the File: Ethical Steps and Best Practices, focuses on your ethical duties once the case is over, including determining when it IS actually over; how to ethically confirm the termination of your legal services; how the file should be retained, and for how long. Along with checklists for different types of practices, receive tips and guidance regarding:

  • The importance of starting the file correctly with the right Agreement
  • Protecting/Returning Client files
  • Advising clients of consequences; further expectations or needs
  • Controlling expectations
  • Explaining effects of adverse rulings
  • Settling accounts
  • Continuing duties to avoid conflicts
  • Ethical advice and analysis
  • Drafting the “Closing Letter”
