The Rise in Reverse Discrimination Cases

In this program, examines the rise in reverse-discrimination cases as corporate diversity, equity and inclusion programs face heightened scrutiny after the Supreme Court's June 29th ruling ending Affirmative Action in college admissions. With this victory, affirmative action critics may begin to focus on challenging private employer DEI programs under workplace anti-discrimination laws, such as Title VII of the Civil Rights Act. While it remains lawful for employers to implement diversity, equity, inclusion and accessibility programs that seek to ensure workers of all backgrounds are afforded equal opportunity, the recent case law, Phillips v. Starbucks Corporation and Duvall v. Novant Health, have created a greater awareness for employers to review their DEI programs for compliance with Title VII requirements. Panelists will also address the attempts to expand the ruling to businesses and the test case currently working its way through the 11th U.S. Circuit Court of Appeals that challenges whether a grant program for businesses run by Black women is constitutional.
