In this CLE, panelists address the contentious issue of taking adjuster’s depositions in workers’ compensation proceedings. In October 2021, Andrew Ruder co-authored an article in the Legal Intelligencer titled, "Few Workers’ Comp Claims Adjusters Are Deposed. It’s Time to Change That.” Arguments have been made that denying the deposition of the adjuster in workers' compensation may run afoul of fundamental notions of procedural due process and allows insurers to operate "unchecked." However, others are quick to counter that the deposition of an adjuster can be harassing and be more of a fishing expedition and thus only serves to bog down an already burdened system with large caseloads.
