This intermediate CLE program is designed to provide a primer on the key ethics rules that apply when advising a tax non-compliant client. After reviewing the various sources of ethics guidance, we will explore what kinds of advice a tax advisor can ethically give a tax non-compliant client and how that advice may vary among attorneys, accountants, and non-credentialled advisors.  Finally, panelists explore real-life examples and the ways in which an advisor might ethically respond.  

Topics include:

  • Overview of the relevant ABA Model Rules and Pennsylvania Rules of Professional Conduct
  • Overview of relevant AICPA Statements on Standards for Tax Services (SSTSs)
  • Summary of applicable sections of Circular 230
  • Tax advisors’ obligations upon discovering an error in or omission from a client’s prior tax filing
  • Is there a legal and/or ethical obligation to file an amended return?
  • Voluntary disclosure versus “playing the audit lottery”
  • When does “materiality” matter?
