Recently, the National Labor Relations Board’s (NLRB) General Counsel has undertaken an expansive approach to interpreting the Act and has announced aggressive initiatives that impact both union and non-union employers. This CLE session will provide an examination of trends in union organizing, including in the social justice and non-profit sectors, as well as an overview of key decisions and guidance issued by the Board. 

The program will address the Board’s current stance on such issues as:

  • Electronic surveillance
  • Work rules
  • Uniform policies
  • Confidentiality and non-disparagement clauses in severance agreements as addressed in last months’ McLaren decision
