Dealing Effectively with “Difficult” Counsel and Parties at Key Moments in Litigation

This one-hour scenario-driven ethics CLE will identify responses to conduct from “difficult” counsel and parties. A moderated panel discussion with describe several hypothetical factual scenarios, each before the Judge in ‘CLE Court’ on Motion for relief. One panel member will support the relief sought, and one will oppose.  Before any ruling, attendees will be informally polled using the chat feature. The Judge will then make and explain a ruling.

Scenarios will be taken from reported decisions and will address the following topics, among others:

  • At Depositions counsel or a party performs as “screamer” or “coach”
  • As local counsel, you note lead counsel ignore applicable Rules or Court deadlines
  • Attorney concludes that opposing counsel is not accurately conveying proposals for discovery procedures, or settlement to the client
