- The best interest of the child standard has become the core principle of child custody law in every state. There are at least 4.1 million parents with disabilities in the United States and many more grandparents or other primary caretakers with disabilities. However, discriminatory presumptions of parental unfitness have harmed people with disabilities throughout U.S. history. This CLE will examine the application of the best interest of the child standard as applied in Philadelphia Family Court to custody litigants with disabilities.
