Voter Suppression Laws, Attacks on Elections, and the Future of Democracy

Voter rights and legislation is a fundamental issue that has guided the principles of “freedom” in America. Its landmark is the Voting Rights Act of 1965. But recent years have seen attacks on election officials, surreptitious new laws stripping away voters’ rights, and fraudulent audits of political elections.  In 2013, Shelby County v. Holder weakened the Voting Rights Act by declaring Section 4's preclearance formula unconstitutional. For that reason, there is no longer federal oversight in areas with histories of discrimination in voting practices and procedures, as well as an increase of discrimination in voting practices and procedures throughout the country. For example, voter ID laws, reduced polling places, voter registration purges, lack of absentee balloting, and "poll taxes" of old remain as hurdles that many low-income, elderly and minority populations currently face in accessing the franchise.

This program will examine present-day challenges to voting and what attorneys can do to address challenges, protect voting rights, and out-organize suppression attempts.  Panelists will address the following, among other issues:

  • The initial enforcement of the Voting Rights Act
  • The recent history that gave rise to voter suppression laws
  • The current schemes of voter suppression and vote dilution
  • The Rights denied to certain segments of the population
  • Review of the different legislative proposals in Congress and in states
  • The tools, including the existing Voting Rights Act, to challenge and fight back in court
