Moving Beyond Brady-Giglio Lists

Brady-Giglio caselaw, and their progeny, have placed upon the district attorney an affirmative duty to disclose material that is favorable, exculpatory, impeachment, or mitigating information from an officer’s personnel file. District Attorneys have created “Brady-Giglio lists” to contain the names of these officers within one location. However, in Fraternal Order of Police Lodge No. 5 v. The City of Philadelphia (2021), Pennsylvania courts have acknowledged an officer’s due process rights in their placement on “Do Not Call Lists”.

Due to the expanding notice and hearing requirements that are placed upon Brady-Giglio lists, defense counsel should not rely solely on these lists to ascertain the character and conduct of involved officers in their litigation. Records revealing an officer’s character and conduct continue to be shielded from discovery—preventing defense counsel the ability to utilize these records in necessary hearings from bail to trial.

This CLE will examine measures to gain access to these records and offer guidance on how to best utilize them within your practice. Most importantly, this CLE will review how defense practitioners may contribute to the toolbox of Brady-Giglio records—preparing a complaint against a police officer when you have discovered a violation of departmental policies or constitutional protections.
