Chapter 55 of the Pennsylvania Probate, Estate and Fiduciaries Code, which explicitly impacts incapacitated persons, was last modified in 1992.  Guardianship proceedings can be expensive, contentious, and lengthy.  In this encore program hear panelists address the options available to you if your client has incapacity issues. Panelists will explore the following topics, among other:

  • The less restrictive alternatives available in avoiding a full guardianship proceeding
  • Supported decision making
  • Advanced planning to avoid guardianships
  • Selecting a qualified expert who understands the gradations of capacity
  • The Legislative response to guardianship reform such as the appointment and role of counsel, payment of guardians, certifications of proposed guardians, and the need for public guardians
