A debate about the impact of fiduciary duties on Environmental, Social And Governance (ESG) investing, and whether they should be recalibrated to reflect the new landscape is still raging.
 

This CLE program will explore the intersection of sustainable and impact investing and fiduciary duties. They will review the exponential growth of sustainable and impact investing over the past several years and describe four distinct investment approaches: ESG integration, ESG mandated, thematic, and high impact concessionary. The evolution of fiduciary law applicable to the utilization of these types of investments will also be addressed, specifically the application of the Uniform Prudent Investor Act to trustees’ investment decision-making. The program concludes with a review of a framework to align different types of ESG investments with various investment and fiduciary mandates.
