A Look at Lorino: Pennsylvania Supreme Court Change in the Law for Attorney Fees

The Pennsylvania Supreme Court has recently issued a ruling that may result in a significant change in the way attorney fees are awarded. By reinterpreting §440 of the Pennsylvania Workers’ Compensation Act, which governs the award of attorney fees, the Pennsylvania Supreme Court’s ruling in Lorino v. WCAB (Commonwealth of Pennsylvania) will have an immediate impact on the litigation of workers’ compensation claims.  This panel examines the Supreme Court’s recent decision and what can be expected in future workers’ compensation litigation.
