Implicit and Racial Bias in the Criminal Legal System

Program originally presented Wednesday, June 15, 2022

Study after study related to recognizing problems with racially disproportionate treatment at all stages of the criminal justice system have consistently shown that implicit bias and racism have played a significant role in the disparate treatment of those who encounter this system. These disparities within the system are often particularly aimed towards black and brown people, including sentencing standards, mass incarceration, attacks on minority groups, traffic stops, post-conviction bias, and jury selection.  How do we identify and confront these biases, as well as develop strategies to combat these biases and racism to reduce their effects on the criminal legal system?

This encore CLE program will examine the definitions of implicit bias and racism and explore how these biases work to cause harm to people who come into contact with the criminal legal system at every level.
