The Philadelphia Bar Association issued the following statement upon release of the U.S. Supreme Court’s opinion in 303 Creative v. Elenis, pitting First Amendment rights against protection from LGBTQ discrimination in the marketplace:
“We were very disappointed in the Court’s ruling, which limits states’ ability to prevent discrimination of LGBTQ people, and potentially other historically victimized groups,” Chancellor Marc J. Zucker said. “Our Association has long supported protection from discrimination and hate for the LGBTQ community. Earlier this week, we urged the General Assembly to enact, and Gov. Josh Shapiro to sign, a nondiscrimination law in Pennsylvania and to increase protections for victims of hate crimes. We fear that this latest Supreme Court decision further complicates the ability to ensure that LGBTQ people feel safe in public and commercial spaces.
