This CLE course will focus on the interplay between Pennsylvania Heart and Lung Act benefits and the Workers’ Compensation Act. The presentation will address the City of Philadelphia’s system for Heart and Lung Act benefits, and explore the variability of litigation of Heart and Lung Act benefits throughout the Commonwealth. Additionally, the presentation will examine the initiation and termination of Heart and Lung Act benefits, litigation of Heart and Lung Act appeals, and how the litigation overlaps with Workers’ Compensation petitions. Lastly, panelists will touch on subrogation under Section 319 of the Workers’ Compensation Act, and how it applies to receipt of benefits under the Heart and Lung Act.
