According to L&I, “occupational disease” must occur while carrying out the interest of the employer. The actual disease does not have to occur on the employer's premises to be covered by workers' compensation. Though there are some diseases related to certain occupations, other illnesses may be very tricky to pin down. Doing so may require significant research by medical and public health experts. Proving a case of occupational disease can be a complicated matter.
This two-hour CLE program will address trying occupational disease cases, with specific focus on procedures, medical evidence, presumptions, and case law. Panelists will offer guidance regarding preparing clients on the defense and claimant sides, and explore best practices using mediation in these complicated cases.
